Driver Terms & Conditions

Introduction
These Terms and Conditions set forth the rights and obligations of you and Hail Technologies Limited ("HAIL") as they relate to your use of the HAIL platform and services, whether you are a licensed taxi driver or a private hire vehicle operator.
1. General
1.1 Definitions
Definitions and interpretation rules used throughout this document are provided in Section 7.
1.2 Description of Services
a) HAIL for Driver is a mobility and payment platform that enables licensed taxi drivers and approved private hire vehicle operators to receive ride requests, accept bookings, and collect payments from passengers using the HAIL app.
b) HAIL facilitates trip matching, fare estimation, electronic payment collection, account management, and support services for drivers.
1.3 Eligibility and Account Requirements
a) To use HAIL for Driver:
- Taxi drivers must hold a valid Taxi Driver Identity Plate issued by the Hong Kong Transport Department.
- Private hire vehicle drivers must have appropriate hire car permits and business registration as required by law.
- All drivers must submit required documents (ID, license, vehicle documents) and maintain a valid Hong Kong dollar bank account for settlements.
b) Access to your HAIL Driver account will be secured via OTP sent to your registered mobile number. You are responsible for safeguarding your account credentials and mobile device. Any activity on your account will be treated as authorized by you.
c) Misuse, unauthorized access, or fraudulent behavior may lead to suspension or termination of your account and reporting to authorities.
1.4 Fees and Settlement
a) Platform fees may apply based on trip type:
- HAIL Taxi: Standard 5% Platform fee and 3% Payment Processing Fee applies to all completed rides
- HAIL Private Car: Standard 5% Platform fee and 3% Payment Processing Fee applies to all completed rides
b) Settlement of your earnings to your designated bank account will typically follow a T+2 schedule, with T+1 options offered periodically.
1.5 Changes
a) HAIL reserves the right to amend these Terms or the Services with prior notice. Continued use of the Services constitutes acceptance of changes.
b) You are responsible for updating HAIL promptly if your personal or banking information changes.
2. Driver Account and Payments
2.1 Receiving Payments
a) Payments for trips completed through HAIL will be collected from passengers and credited to your Driver account.
b) If a payment was made in error or was unauthorized, you agree to return it. HAIL may deduct such amounts from your account or future payouts.
2.2 Refunds
a) You are responsible for the ride experience. If a passenger disputes a charge, HAIL will investigate and may deduct or refund from your balance accordingly.
b) Refund amounts will not exceed the original fare, and will be processed based on the balance available in your account.
2.3 Settlements and Withdrawals
a) Your account balance will be held in your HAIL wallet until you authorize a transfer to your designated bank account, subject to transfer limits and fees disclosed in advance.
b) All payout instructions are final and cannot be reversed once submitted.
2.4 Records and Disputes
a) You must verify your trip and earnings history regularly. Contact HAIL support promptly for any discrepancies.
b) Notifications about transactions will be sent via app, SMS, or email. You are considered notified upon delivery.
3. Use of Your Information
3.1 Personal Data
See the HAIL Personal Information Collection Statement for how your data is collected, stored, and used.
3.2 Analytics and Improvement
Your app usage data may be used for:
- Service quality improvement
- Safety analysis and fraud prevention
- Personalized driver insights and performance reports
4. Obligations
4.1 Our Obligations
HAIL will:
- Provide the platform and support
- Securely process transactions and data
- Investigate issues reported by drivers or riders
HAIL’s liability is limited to direct losses caused by proven gross negligence.
4.2 Your Obligations
You agree to:
- Operate your vehicle lawfully and professionally
- Provide safe and respectful service to passengers
- Maintain updated personal, vehicle, and bank details
- Promptly respond to HAIL support requests
- Display HAIL signage when required
You must not:
- Engage in fraud, misuse, or disruptive behavior
- Impose unauthorized fees on passengers
- Tamper with app systems or payment processes
5. Force Majeure
HAIL is not responsible for service interruptions due to external events including natural disasters, network outages, or regulatory restrictions.
6. Termination
6.1 By HAIL
HAIL may suspend or terminate your account immediately if:
- You violate these Terms
- You provide false documents or commit fraud
- You breach laws or licensing conditions
6.2 By You
You may close your Driver account at any time by contacting HAIL support.
6.3 Account Closure
Upon closure:
- Remaining balance will be paid out to your bank account
- HAIL signage must be removed from your vehicle
- Access to HAIL Driver features will be revoked
7. Miscellaneous
- Governing Law: These Terms are governed by Hong Kong law.
- Language: In case of discrepancies, the English version prevails.
- Amendments: HAIL may update these Terms periodically.
- Severability: If any clause is deemed invalid, the remainder remains enforceable.
- Third-Party Rights: Only you and HAIL can enforce these Terms.
8. Definitions
- "App" – The HAIL Driver mobile application.
- "Driver Account" – Your in-app earnings and settings dashboard.
- "Services" – HAIL's trip matching, payments, and driver support tools.
- "Platform Fee" – The amount retained by HAIL per transaction.
- "We", "Us", "Our" – Hail Technologies Limited.
- "You", "Your" – The licensed driver using HAIL to accept and complete ride requests.
